Residential Subscriber Agreement

Cajun Broadband, Inc. (hereinafter referred to as "We", "Us", or "Our") is pleased to offer you access to our website (www.cajunbroadband.com) and the services available thereon (collectively, the "Service"). 

Your access and use of the Service is conditioned upon your acceptance of and compliance with the following terms and conditions (the "Terms"). These Terms, together with any policies and operating rules published by Us on this website, constitute the entire agreement between you and Us regarding your use of the Service. 

BY ACCESSING OR USING ANY PART OF THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ANY PART OF THE TERMS, THEN YOU MAY NOT ACCESS OR USE THE SERVICE.    

1. Intellectual Property 

The Service and all content, products, and services offered through the Service, including the underlying software and technology (collectively, the "Content") are Our intellectual property or the intellectual property of Our licensors. The Terms do not transfer any ownership rights to You. All right, title, and interest in and to the Content will remain solely with Us and Our licensors. 

2. Third-Party Services 

The Service may contain links or references to third-party services ("Third-Party Services"). We do not endorse or control Third-Party Services, and we are not responsible or liable for any content, products, or services offered by Third-Party Services. 

Your use of Third-Party Services is at your own risk. We encourage you to review the terms and conditions and privacy policies of any Third-Party Services before using them.    

3. Accounts 

If you choose to create an account to use certain features of the Service, you agree to provide Us with complete and accurate information when registering for the account. 

You are solely responsible for maintaining the confidentiality of your account information, including your password. You are also solely responsible for all activity that occurs under your account.    

You agree to notify Us immediately of any unauthorized use of your account or any other security breach.    

4. Termination 

We may terminate or suspend your access to all or any part of the Service at any time, with or without cause, with or without notice.    

You may also terminate your account or use of the Service at any time. 

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.    

5. Disclaimer 

The Service is provided "as is" and "as available." We and Our suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.    

We do not warrant that the Service will be error-free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Service at your own discretion and risk.    

6. Revisions to this Agreement 

We may occasionally revise and update these Terms. We will notify you of any material changes by posting the revised Terms on the Service or by sending you an email or other communication. 

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the revised Terms. 

7. Governing Law and Jurisdiction 

These Terms and your use of the Service will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.    

Any dispute arising out of or relating to these Terms, or your use of the Service will be subject to the exclusive jurisdiction of the state and federal courts located in the United States.    

8. Entire Agreement 

These Terms constitute the entire agreement between you and Us regarding your use of the Service.

Business Subscriber Agreement

This Subscriber Agreement (the "Agreement") is made and entered into as of August 12, 2024, by and between Cajun Broadband, Inc. (referred to herein as "Cajun Broadband," "we," "us," or "our") and the individual or business entity accepting these terms (referred to herein as "you," "your," or "customer"). 

WHEREAS, Cajun Broadband desires to provide high-speed internet access and related services (the "Services") to businesses, and 

WHEREAS, Customer desires to subscribe to and use the Services; 

NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 

1. Services 

Cajun Broadband agrees to provide Customer with access to the Services, which may include, but are not limited to, internet access, data transmission, and related features, as described on Cajun Broadband's website (www.cajunbroadband.com) and in any applicable service plans. 

2. Term and Termination 

  • Term: This Agreement shall commence on the Effective Date (as defined below) and shall continue for an initial term of three years (the “Initial Term”), unless earlier terminated as provided herein. The date this Agreement is first executed by both parties shall be the “Effective Date.” 

  • Termination by Cajun Broadband: Cajun Broadband may terminate this Agreement for any reason, with or without cause, upon 30 days of written notice to Customer. 

  • Termination by Customer: Customer may terminate this Agreement 30 days written notice to Cajun Broadband. 

  • Termination for Cause: Either party may terminate this Agreement for cause upon written notice to the other party if the other party breaches a material provision of this Agreement and fails to cure such breach within 30 days after written notice of such breach.    

  • Effect of Termination: Upon termination of this Agreement for any reason, all of Customer’s rights to use the Services shall immediately cease. Customer shall be responsible for payment of all accrued and unpaid charges up to the date of termination. The following provisions of this Agreement shall survive termination: Sections 5 (Disclaimer), 7 (Governing Law and Jurisdiction), 8 (Entire Agreement), and 9 (Contact Us). 

3. Fees and Payment 

  • Fees: Customer agrees to pay Cajun Broadband the fees for the Services as set forth in the applicable service plan chosen by Customer. Fees are due and payable in advance on the first day of each billing period. 

  • Taxes: Customer shall be responsible for the payment of all applicable taxes, fees, and surcharges associated with the Services. 

  • Late Payment: Notify Cajun Broadband of any possible delays in payment. Failure to receive payment by the due date may result in service suspension or termination, if the issue persists after notification. 

  • Suspension of Services: Cajun Broadband may suspend Customer's access to the Services if any payment due hereunder is not received by the due date. 

4. Intellectual Property 

The Service and all content, products, and services offered through the Service, including the underlying software and technology (collectively, the "Content") are the intellectual property of Cajun Broadband or its licensors. This Agreement does not transfer any ownership rights to Customer. All right, title, and interest in and to the Content will remain solely with Cajun Broadband and its licensors. 

5. Disclaimer 

The Service is provided "as is" and "as available." Cajun Broadband and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.    

Cajun Broadband does not warrant that the Service will be error-free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Service at your own discretion and risk.    

6. Limitation of Liability 

In no event shall Cajun Broadband, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with this Agreement or the Services, even if Cajun Broadband has been advised of the possibility of such damages.    

7. Governing Law and Jurisdiction 

These Terms and your use of the Service will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.  

Any dispute arising out of or relating to this Agreement, or your use of the Service will be subject to the exclusive jurisdiction of the state and federal courts located in the United States.
